This webinar will cover HUD regulations, Office of General Counsel guidance, and the PHA’s policies regarding HCV terminations and informal hearings.
There is HUD criteria for termination of assistance in the HCV program. We will discuss what considerations the PHA should apply when these termination cases arise. The PHA’s decision to terminate based on criminal records, VAWA, and reasonable accommodation will be discussed.
HUD regulations stipulate when an informal hearing must be afforded and when an informal hearing is not required. There are some policy decisions to be made in these considerations, which will be discussed.
Regarding informal hearings, the hearing officer’s decision is based on preponderance of the evidence and whether the PHA followed all due process; these will be discussed in depth.
This webinar will also cover HUD’s definition of an impartial hearing officer, the prohibition of ex parte communications, the quality of evidence (including hearsay), and conducting the hearing. Strategies for conducting hearings remotely will be provided.
This webinar will help hearing officers, HCV directors, managers, and staff understand the regulations, PHA policy options, and best practices regarding HCV terminations and informal hearings, as well as where PHAs are most likely to lose in court upon appeal by participants.
